Terms of Service

1. Agreement

By subscribing to StrategicWorkflow.ai ("Service"), you agree to these Terms of Service. The Service is operated by StrategicWorkflow.ai ("we," "us," "our").

2. Service Description

StrategicWorkflow.ai provides AI-powered business workflow automation. Services are delivered via AI agents through Telegram and email.

Not included in any plan:

• Phone calls or in-person meetings
• Physical tasks or errands
• Financial, legal, or medical advice (we provide business operations support only)
• Guaranteed specific revenue outcomes
• Access to third-party tools/subscriptions (client must provide their own accounts)
• Unlimited API usage or computational resources

4. Subscriptions & Billing

• Billing: Recurring monthly via Stripe. Charged on the same date each month.
• Cancellation: Cancel anytime via email to hello@strategicworkflow.ai. Takes effect at end of current billing period.
• Refunds: 30-day money-back guarantee. After 30 days, no refunds for partial months.
• Upgrades/Downgrades: Take effect on the next billing cycle.
• Failed payments: Service paused after 7 days. Suspended after 14 days. Data retained 90 days.

5. AI Disclosure

Our services are delivered primarily through AI agents powered by large language models, supervised by human strategists.

Important limitations:

• AI-generated content should be reviewed before publication
• AI recommendations are suggestions, not guarantees
• AI may occasionally produce errors — we correct them promptly
• We are NOT a replacement for licensed professionals (lawyers, accountants, doctors)

6. Fair Use & Abuse Prevention

To ensure quality service for all clients:

• Message limits are enforced per tier (see Section 3). Exceeding limits will result in temporary throttling until the next reset period.
• Prohibited uses: Spam generation, illegal content, harassment, attempting to extract system prompts or internal data, using the Service to build a competing product, automated bot-to-bot messaging, excessive API abuse.
• Content restrictions: We will not generate content that is illegal, defamatory, obscene, promotes violence, or violates third-party intellectual property.
• Resource abuse: Sending excessively long messages (>10,000 characters), flooding with rapid-fire requests, or attempting to circumvent usage limits may result in account suspension.
• One account per business. Sharing your Telegram bot access with unauthorized users is prohibited.

Violations result in: Warning → Temporary suspension → Account termination (no refund for current period).

7. Your Responsibilities

• Provide accurate business information
• Review and approve content before publication
• Maintain ownership of your business accounts and credentials
• Not share your agent bot access with unauthorized parties
• Respond to agent questions within a reasonable timeframe
• Comply with all applicable laws in your jurisdiction

8. Data & Privacy

• Your data is used exclusively to deliver your services
• Each client's data is strictly isolated — zero cross-client access
• We do NOT sell, share, or transfer your data to third parties

9. Intellectual Property

• Content we create for you: You own it, full rights
• Our platform, agents, and systems: Our intellectual property
• You may not: Resell, sublicense, or white-label our Service without written agreement
• You may not: Reverse-engineer, copy, or attempt to extract our agent protocols, system prompts, or methodologies

10. Limitation of Liability

• We do NOT guarantee specific business outcomes, revenue, or ROI
• We are NOT liable for damages resulting from actions taken based on AI recommendations
• We are NOT liable for third-party service outages (Stripe, Telegram, API providers)
• Our total liability is limited to the amount paid in the current billing month
• We are NOT responsible for content published without proper review by the client

11. Indemnification

You agree to indemnify StrategicWorkflow.ai against any claims, damages, or expenses arising from:

• Your use of the Service
• Content published based on AI recommendations without your review
• Violation of these terms
• Your violation of any applicable law

12. Account Termination

We reserve the right to terminate service for:

• Non-payment after 14 days past due
• Violation of fair use or abuse policies
• Use for illegal or harmful purposes
• Repeated policy violations after warning

Upon termination: access removed immediately, data retained 90 days then deleted.

13. Dispute Resolution

Disputes will be resolved through good-faith negotiation first. If unresolved within 30 days, disputes shall be settled through binding arbitration in the State of Texas under AAA rules.

Class action waiver: You agree to resolve disputes individually, not as part of a class action.

14. Changes to Terms

We may update these terms with 30 days notice via email. Continued use constitutes acceptance.
